The protection of your personal data is important to us.

Your privacy is important to us and we want you to understand our practices with respect to the gathering and handling of your personal data.

1. Introduction

This Privacy Statement provides information on the processing of your personal information by ExxonMobil Petroleum & Chemical BV (“ExxonMobil”, “Esso”) through your use of the Esso Pro Application (“Esso Pro”).

Esso Pro facilitates your fueling and payment transaction with the operator of the Esso branded service station from which you make a purchase. By using Esso Pro, you are not purchasing products from Esso.

Your privacy is important to us and we want you to know what information Esso collects through Esso Pro, how we collect it, what we use it for and who we may share your personal information with. This Privacy Statement may be changed over time. You are advised to regularly review the Privacy Statement for possible changes. By using Esso Pro, you are consenting to these Privacy Terms.

Special note:

Esso Pro should not be used by anyone who is under the age of 16. If you are under 16 years old please do not use Esso Pro and do not send us your personal information (for example your name, address or email address).

2. Data Collection

Esso Pro is a propriety of ExxonMobil Petroleum & Chemical BV (“Esso”), therefore Esso accesses information collected through Esso Pro. If you have any questions about the content of this Data Privacy Statement, please contact the Data Privacy Office at the following address:

3. What information do we collect?

Esso Pro will allow you to submit personal information, that is, information that could identify you as an individual. When you register on Esso Pro, PACE. (PACE Telematics GmbH, Haid-und-Neu-Str. 18, 76131 Karlsruhe, Germany) will collect and store your personal data, such as email address, as well as your transactional data such as date and time, location, product, quantity, amount and payment method of your purchase at an Esso branded service station. If you are a holder of a loyalty card that is onboarded in Esso Pro and you wish to collect points on qualifying purchases, your loyalty card number will also be collected and stored.

If you submit customer feedback or complaint, or any other information to us, you may also provide us with additional personal information.

4. Why do we collect information?

We collect, store and use the personal information to provide you with digital products or services, to deliver other relevant information to you such as transaction receipts, support messages, details of loyalty points collected.

Furthermore, we may use information collected about you for statistical purposes that help us analyse the usage and performance of Esso Pro, in order to improve your experiences.

We may use personal information to protect our rights and to investigate and prevent fraud or other illegal activities and for any other purpose disclosed to you in connection with our services.

5. Sharing Information with Third Parties

Esso does not sell or distribute the personal information it collects via Esso Pro to third parties for allowing those third parties to market their products and services to you. In order to process the payment transactions, Esso provides transactional data on a transaction-per-transaction basis to the service station operator where the transaction took place as well as to the Esso Card issuer (WEX Europe Services Limited & WEX Europe Services SAS). Transactional data shared is limited to date and time, location, product, quantity, amount and payment method of your purchase at Esso stations. Whilst we do not provide name, address or other contact details to the service station operators, the service station operator may be able to derive certain additional information from such transactional data, for instance in combination with CCTV installed by the service station operator at the service station. In addition, Esso may provide aggregated transaction data to any of the operators of Esso sites however again without reference to names, email addresses or fleet/loyalty card number.

Esso does employ other companies and individuals to perform certain functions on its behalf. Examples include hosting Esso Pro, processing payments, processing loyalty information. Those third parties may have access to personal information, but will only have access to the information needed to perform their functions, and cannot use it for any other purpose. They must process the personal information in accordance with this Privacy Statement and as permitted by applicable data protection laws.

We have agreements in place with those third parties providing Esso Pro service obliging them to protect the security and confidentiality of the personal information consistent with applicable policies and laws.

If you choose to share Esso Pro or any of its content through social media such as Facebook, Linked In, Instagram and / or Twitter, your personal information (such as your name and the fact that you are interested in Esso) will also be visible to all the visitors of your personal webpage on those social media sites. On the use of such social media websites, refer to the terms and conditions (including privacy statement) of that social media site. Esso is not responsible for the processing of personal information or the privacy policy of social media websites, and Esso’s Privacy Statement is not applicable to those sites.

6. Data transfers & sharing information with ExxonMobil Affiliates1

We may transfer the personal and transactional information we collect about you to countries other than the country in which the information was originally collected. These transfers are limited to transfers to affiliated ExxonMobil companies so that we may analyse the data in order to improve our products and services. When we transfer the personal information to other countries, we will protect that information as described in this Privacy Statement. By using Esso Pro and submitting data to Esso Pro, you provide express consent to these transfers, including trans-border transmission of data covered by this Privacy Statement.

We comply with applicable legal requirements providing adequate protection for the transfer of personal information to countries outside of the UK, EEA or Switzerland including execution of standard contractual clauses by ExxonMobil and its affiliated companies1 as needed.

7. Data Security

We are committed to ensuring that the information collected about you is secure. We take reasonable measures including administrative, technical and physical procedures to protect your information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. Your full fleet or loyalty card details are not stored on your mobile device and we also only show masked fleet or loyalty card numbers on Esso Pro. The level of security can only be effective if you follow certain security practices yourself including using unique and strong passwords, never sharing your account or login details with anyone and by using the available mobile device security features. If you believe that any of your account login details have been exposed, you can change your password at any time through Esso Pro.

8. Opt Out/Modify Information

If you no longer wish to use Esso Pro, you can uninstall Esso Pro. You can request the removal or modification of your personal information by sending an e-mail to the Data Privacy Office (see address in Section 2). We will delete or render anonymous any personal information that is no longer needed.

9. Your Rights

When living in a country with comprehensive data privacy laws, certain rights in relation to the information collected may apply, including:

  • The right to know and see what personal information is processed;
  • The right to have inaccurate personal information corrected or deleted;
  • The right to withdraw consent to the processing of the personal information. In this case, you will no longer be able to use Esso Pro. In this case you should uninstall / remove Esso Pro.

10. Data Retention

Esso and its affiliated companies may retain personal information you provide for the duration of the services and for as long as is necessary to provide support related reporting and trend analysis. Individual transaction data will be securely stored according to ExxonMobil’s data retention guidelines for transactional data. Receipts that are stored in Esso Pro will be visible for 90 days and will be automatically removed after those 90 days.

11. Conditions of Use, Notices and Revisions

If you choose to use Esso Pro, your use and any dispute over privacy is subject to this Privacy Statement and the Terms & Conditions, including any limitations on damages, arbitration of disputes and application of law. We reserve the right to change this statement at any time without notice.

We may change this Privacy Statement from time to time by posting the updated version on Esso Pro. We advise you to review this page regularly to stay informed and to make sure that you are happy with any changes. If we make material changes to this Privacy Statement, we will notify you via email or within Esso Pro. If you object to any of the changes to our terms, you are free to stop using our services, delete Esso Pro and request for your personal information to be deleted.
